Are Lawyers Ethical?
by champathon achille - Sunday, 24 February 2008, 08:28 AM
Anyone in the world

By Lance Winslow Many believe that Lawyers are not ethical human beings and that they do not enforce the law or protect the rights of our society. Many believe that lawyers merely use the law and re-interpret the law for the advantage of those paying them to do so. Therefore they are being unethical to the law the purport to serve, as they manipulate the law to mean whatever it is that they wish it to mean for the highest paying clientele. Now some would argue that they are ethical and helping their clients from being abused by law. Yet if so they are not enforcing the law, but modifying either its intent, definition or letter of the law using case law and arguments which are vaguely relevant to any particular reality of the law. So when arguing the question are Lawyers Ethical, one would have to come to the conclusion that they are pragmatic at best and outright criminals at worst. Yet any lawyer worth his salt will immediately object to such statements and say ask the questions; What do you mean when you say Ethical? What is your definition of Law? What do you consider a definition? What exactly is a client? What exactly is reality? What do you mean by the comment of pragmatism? This is how a lawyer can justify their criminality or decisions to hide in the shawdows of the gray area of law and proclaim themselves members of a noble and ethical profession and slayers of evil as they enforce the laws for the betterment of the whole of our civilization. Of course all their talk and boloney is pure and utter hokum, but it is nice to know where they are coming from as the refute Caesars best advice; the first thing we do is kill all the lawyers! In fact if lawyers were as ethical as they say, we would not have to kill them, as they would kill themselves to save our civilization from their obvious attacks on the truth and our laws. Crowd Anxiety
by champathon achille - Thursday, 21 February 2008, 02:00 AM
Anyone in the world

By Justin Meyer Especially during the holiday season, you can find yourself in some very crowded situations. It can be very tense, and your reaction might start to get hostile. You may find that you are getting jumpy and nervous. You may also find that you start to feel crowded in, have problems breathing. It is a form of claustrophobia and can be fixed with a few calming techniques. However, you want to try and avoid the situation whenever possible. Because the situations will invariably raise your stress levels, you want to try and keep calm, try and stay relaxed as often as possible. And since you will inevitably end up in these situations at times, the best thing to do is try and find ways to stay calm whenever you can. The first thing that you can do is make sure you have a clear exit path. Know exactly how you want to get out of the situation and know how you are getting there. It may help for you to keep one eye on that exit path to make sure it doesnt get blocked off. And if it does, you can start looking for another one. Finding a few exit routes in the beginning might be helpful. You might also want to start shopping during the middle of the day, or online. Because there are less crowds, you will be able to control your entry and exit a little more, you wont be jostled as much and you might feel more comfortable. Online, you have no people and you should feel fine. How To Be Romantic On Your Wedding Day
by champathon achille - Tuesday, 19 February 2008, 07:18 AM
Anyone in the world

By Emily Tanner Organizing your wedding should be the most romantic occasion of your lives. But lets face it the wedding guests seem to get more attention paid to them than the bride and groom themselves. Hours are spent on who will sit where, what the guests will eat, evening entertainment, writing endless invitations and paying through the nose for the most exquisite venues. This is without mention of the happy couple spending most of their wedding day checking that everyone else is having a great time! This is not to say that good wedding etiquette should be forgotten, but it seems sad that the bride and groom themselves dont get much of the action. So, how can you be romantic on your wedding day? Well, the best place to start is before the wedding itself. Despite all the stress of wedding planning, make time for each other and do little romantic things each week. You could put 10 notes around the house each with a different reason why you love your partner. Or you could fill the bath with red rose petals and line up romantic candles around it. As you are staring onto space whilst at work, daydreaming about your wedding day, send your partner a string of short emails. Tell them how much you are looking forward to your big day and how you cant wait to be his wife. On the actual wedding day, you could start being romantic by giving your fianc a special present and a card. Let him open it on the morning of your wedding day. As much as finances will allow, buy something a little bit special that he can keep and treasure for always. If you are not spending the wedding morning together [and tradition states that you shouldnt be together] then make sure his favourite cereal/croissant or fruit juice is well stocked up in the cupboard. You can leave him a note to tell him its there or ask your best man to tell him. This is not only a romantic gesture but a great way of ensuring he has had something to eat! If possible, arrive at your wedding destination in a certain way so that your fianc sees you first. Allow him to have a few moments taking in the vision of his beautiful wife-to-be. Exchange a knowing glance with each other that only you two can see. Look into each others eyes when you say your vows. It may sound like an obvious one, but it so important to really focus on each other when saying your vows. Make it really clear to your husband that you love him and are making your vows from the bottom of your heart. Have a romantic kiss when you are pronounced husband and wife. You dont have to go too mad, but a peck on the cheek does not really do the job at this highly romantic part of the wedding. So, make the most of it and indulge in a lingering kiss as a married couple. Arrange to have a special message delivered to your reception to say Thank You to your new husband. This could be in the form of his favourite tipple, a bottle of champagne or even some balloons. Despite this sounding cringe worthy, it will be really well received. Invest in some pretty underwear for your wedding night. This one speaks for itself. Take the time to choose something different and special so that he will be bowled over when you reach your honeymoon suite. Remember, that your wedding day is just the start of your marriage that you want to last for a lifetime. Being romantic and making each other feel valued will need to be part of your lives, so dont just save it for special occasions. Make every day in your marriage a romantic one and you are guaranteed to have a happy, long and fulfilling marriage. To Attract More Clients - Plug Into Your Purpose
by champathon achille - Saturday, 16 February 2008, 10:03 PM
Anyone in the world

By Fabienne Fredrickson If youve been in business for a few years, youve probably been marketing your business for just as many years (hopefully). Youve tried marketing tactics that worked, and if youre anything like me, youve tried some that didnt and failed miserably. After a while, I believe everyone gets into a slump with their marketing plan. This happens with a majority of my clients at some point or other, and has happened to me too in the past. There are many reasons for this: We get bored.
We get complacent or lazy.
We become greedy or simply in it for the money. I could give you solutions to all three of these reasons, but these would be using your willpower and discipline. Today, I want to appeal to your sense of purpose. If you want a successful business, having a purpose in marketing your business is an absolute necessity, and it shouldnt be just making money. Yes, making lots of money is great. Money is necessary and it makes life way easier. But if the ONLY reason youre in business is to make money, I believe that for most people, its much more difficult to get up the strength to market something that just takes from people, without giving back more than what you give. Besides, people will feel that energetically and read right through you. The solution? Connect (or reconnect) to your purpose. If youve been dragging your feet about getting out there to market your business, perhaps its time to reexamine if youre connected to the original purpose for getting in business. Im a big fan of Ralph Marstons Daily Motivators and he recently wrote something on the subject of purpose that really resonated with me: Where there is purpose, there is energy. Actions directed toward a compelling purpose will create a powerful momentum that lines up events and circumstances in your favor. Purpose gives you a reason to get going each day and strengthens your determination to persist when the going gets tough. Purpose pushes you firmly toward your highest level of accomplishment. I couldnt agree more. Ive talked in the past about letting yourself be pulled by your future. Today, well call it being pulled forward by your purpose. If you look at any great humanitarian leader, youll notice theyve had many obstacles and tribulations along the way. Somehow, they always seemed to get right back on that proverbial horse and try, try again, didnt they? If theyd been in their cause just for the power or the money, they may have given up shortly after starting. But Ill guess that their strong purpose gave them the strength and determination to keep going, to push through the obstacles and reach their goals, because there was a greater purpose to it all. When I see a client who starts to drag their feet or for whom somethings not going well, its usually a sign that somethings not quite right, as opposed to just procrastination. Either theyre marketing something for the wrong reason or theyre not being true to their purpose and the reason that theyre here. For many, theyve chosen to ignore the nagging voice within that tells them somethings not right. Perhaps they dont even know WHAT their purpose is. For many of us self employed people, its to serve others and make a difference in peoples lives, in one way or another. My opinion is that when we get away from that, marketing or doing anything in business is much more difficult. And yeah, by the way, when we are authentic, serve people well and stay connected to that purpose, the money inevitably flows. The best part about making good money doing something that really matters to you is that the money is a byproduct of doing things well and for the right reason. It feels great, not sleazy or like weve ripped off someone. Your purpose is to help others AND to feel good doing it. Once you find it, throw yourself into it. Since having a strong purpose in your business gives you more energy and determination, its time to either get reconnected to the reason you originally got in business or to figure out what yours is. Remember though, sometimes our resolve gets tested to make sure we REALLY want this badly enough. Persevere; dont give up. YOUR ASSIGNMENT: Whats YOUR purpose? Here are questions to ask yourself to find your own purpose or reconnect to it: What section of the bookstore do you gravitate towards? (I was reading success-mindset and marketing books on my honeymoon and it didnt feel like work.)
What is the greatest challenge you overcame?
What brings the most meaning to your life?
If you had all the money you needed, but still wanted to work, what would you do to make a difference in the world while bringing you happiness? Whether it means connecting to it for the first time or simply reconnecting, do what it takes to live as close to your purpose as possible, no matter what the setbacks. Tweak the way you do things right now so it feels right and like theres real meaning in your life. Success will naturally come to you when you do. You wont believe you get paid to live it. 2006 Client Attraction LLC. All Rights Reserved. 5 Secrets Of Setting And Reaching Your Weight Loss Goals
by champathon achille - Friday, 15 February 2008, 07:58 PM
Anyone in the world

By Bill Urell Good intentions for weight loss are wonderful. Like a whole lot of folks, I swore I would start to exercise more, go on a diet, and lose those extra pesky pounds for good. Months later, I'm still deciding on the 'best' diet for me, and paying the monthly gym dues for visits that I am 'just about' to get around to. What's the hold up? I had the best of intentions to lose weight and keep it off. I never got started. According to the experts, I failed because I didn't have a specific, workable, weight loss plan. Studies in the Journal of Personality and Social Psychology found that people with firm action plans were more likely to engage in goal driven behavior, (eg.weight loss). In my case, I wanted to lose weight and start a healthier lifestyle. But as you can guess, this isn't as easy as just writing down "Lose weight and exercise more", and sticking it on the bathroom mirror. Developing an action plan is a process you must go through, really think about, clearly visualizing what you want. By answering the following questions, you can create your own weight loss and exercise action plan. What are my goals? What, exactly, do I want to achieve? Get those ideas out of your head and on to paper. That helps to make them concrete and doable. Who doesn't like checking off lists when they get done? There are five specific things you should keep in mind when writing down all of your weight loss goals: 1. Make your goals specific. Don't say you 'need to lose weight' or I'm 'going to lose weight', say you will do it. For example: "I will lose 15 lbs and take a walk every evening." 2. Make your excercise and weight loss goals measurable and specific. 'I'll walk on the treadmill three times a week for a half hour at a speed of 3.5 miles an hour'. 3. Write down your chosen goals. Create both short term and long term goals for losing weight. Keep a chart or journal to track progress and give yourself some encouragement as you reach your weight loss milestones. 4. Set deadlines. Make your weight loss goals not only measurable, but time specific. Set your weight and exercise goals realistically. It's hard to pursue goals that can never be attained. Unrealistic goals that never seem to be reached can add to your stress level. 5. Give yourself emotional reasons for continuing to lose weight. What moves you to action? Imagine your feelings when you succeed. What will your reward for achievement be? Write it down and plan for it. When should you begin? How about right now! It's decision time. You can continue to dream about a healthier life style, starting to lose weight and looking better, or you can do something about it today. You can stay stuck in your rut, or you can make a change. You can put off your happiness until another day, or you can begin doing positive things now, that you know you are capable of doing. The choice is yours. It's easy to fall into the trap of 'someday.' Someday I'll lose those extra pounds, but right now I have so many other things to take care o'f. The truth is, you will always have things to take care of, people to see, and places to go. You have to make time for a better life for yourself because you are worth it. Now that you know how to set up a specific, goal oriented, weight loss action plan, there is nothing stopping you! Natural Cures for Insomnia
by champathon achille - Thursday, 14 February 2008, 05:10 PM
Anyone in the world

By Greg Cryns Like most ailments, it is difficult to relate to someone who has insomnia if you have never experienced insomnia for yourself. The importance of sustained sleep is easily under-rated. People who have true insomnia often wake up very tired or they are soon enveloped in a full feeling of fatigue after an hour of wakefulness. Insomniacs will seek naps during the day when most people are in full throttle doing their regular activities. I have experienced insomnia for the last three years since I contracted a rare disease. I am not sure exactly what caused my insomnia, but I can tell you that it affects my life so much so that I can barely remember what it was like to be fully awake during the day. I can get to sleep within an acceptable time, but often I will wake up an hour later. Then I might doze off again only to wake up in another hour or so. This patter will repeat itself during most of the night. You can imagine how my body reacts to consistent disruption of a normal human pattern. I did gain a lot of weight after my operation. Perhaps this is causing my insomnia. I used to sleep on my back, but now I feel compelled to sleep on my sides. Either side will do to help get to sleep. My wife says I often snore at night and I am convinced that this is caused by my obesity so it is a short leap to believe my weight problem also causes the insomnia. I have never gone the prescription route to use sleeping pills or even over the counter chemicals. I believe that we all just take too many antibiotics and pharmaceutical "cures." Frankly, I am fearful of the side effects of drugs that often do not show up for many years. I used to smoke cigarettes but my illness provided an excellent opportunity to quit the evil weed after 30 years. I do not want to become dependent on anything again.
What are some good natural treatments for insomnia? Herbs and Supplements Melatonin is another alternative used to induce sleep. You may have heard of people using it for jet lag. This hormone is naturally produced in the body. Melatonin is usually ingested within an hour of bedtime. Some contend that melatonin can cause depression and schizophrenia. No typeical side effects have yet been discovered but always consult your practitioner when taking any drug. Valerian is an over-the-counter herbal treatment for insomnia. The side effects can be indigestion, headache, palpations, dizziness. But the clinical trials as still non-conclusive. Valerian's odor can be offensive so most people take it in capsule form. Usually it is taken at bedtime. Do not take this herb along with other medications, especially with alcohol and other drugs that depress the system. Consult your practitioner before using any drug, herbal or otherwise. Kava is another herbal remedy used by many people especially if your insomnia has something to do with anxiety. The FDA issued a warning about Kava that it may cause liver damage if used as a dietary supplement over long periods of time. Always consult your practitioner before using any drug, herbal or otherwise. I found an online audio that helps me relax. The audio was made by a hypnotist. I listen to the audio regularly for the last two weeks, but I cannot report any change in my insomnia yet. Here is the page of the hypnotist: http://gawain.membrane.com/hypnosis/freehypnosis2.html Many relaxation techniques are getting good press in relation to curing insomnia. The use of relaxation techniques as a way to treat insomnia is rapidly becoming popular. The current thought says that we must use such a technique for 20-30 minutes before going to be to achieve the best effects. Yoga, a widely accepted as a very effective calming technique, is wonderful for its breathing and stretching. Yoga will definitely relax you if you do it properly. If one is relaxed sleep should be easier to maintain. The Progressive Muscle Relaxation technique ,invented by Edmund Jacobson. trains groups of muscles to relax. This new system is well worth your time to explore. Try visualizing a totally relaxing atmosphere where you know you would be calm, cool and collected. Visualization is any technique for creating images, diagrams, or animations to communicate a message. For more information and some great relaxation graphics go to the National Sleep Foundation website at http://centers.sleepfoundation.org/insomnia Here are some specific things you can DO to cure your insomnia: 1. Cut out caffeine 2. Avoid sweets 3. Eat magnesium-rich foods (legumes and seeds, dark leafy green veggies, wheat bran, almonds, brewer's yeast, whole grains) As you can see, there are many ways to overcome insomnia. Drugs may be required for some situations, but more often than not you can end your insomnia with some serious effort without drugs. Greg Cryns is a website promotion expert and the owner of

Organic Shopping: Going for the Cheap? Please Don't
by champathon achille - Wednesday, 13 February 2008, 08:09 AM
Anyone in the world

By Susan Yurek I honestly think the world of people who have made the commitment to vegan and/or organic changes in their lives, and like most, am beginning to reflect a more relaxed attitude that seems to come with that lifestyle. What is most exciting, and a big reason I got into the business of organic bedding and textiles, is the deep connection to Fair Trade practices that promise living wages, health care and dignity to farm workers around the world. As Fair Trade products become more popular here, more and more families around the globe are now living in decent housing and eating better. Talk about an obvious solution to global hunger! Fair Trade, and organic certification, of course, do add to the cost, which is difficult for some consumers to understand. It is unfortunate that some organic retailers respond by taking the Wal-Mart approach, and cheapening organic products to attract customers. Not easy to do though, because organic cotton and organic wool are not nearly as plentiful as those online hawkers would suggest. ("LOWEST PRICES!", "HUGE SELECTION", "LOWEST PRICES ON THE WEB!", etc. Ugh.) Of course the most helpless will lose. In the business world, it's now trendy to strip wages and fire employees in order to undercut prices. (Let's save opinions about offshoring American jobs for another day.) We must find it particularly egregious to do this to an organic industry that has always been deeply committed to humane Fair Trade initiatives. On organic farms and cooperatives overseas, the tactic repeatedly devastates the lives of innocent farm workers. Ethical organic retailers gladly walk that difficult line between responsibility to the industry and Fair Trade initiatives, and offering our customers competitive pricing whenever possible. Those same ethical retailers (at least in my clique) are appalled at the cheapening of an organic industry we truly support. I would wish that savvy organic consumers everywhere would boycott, shun, or do whatever is their style, to denounce that behavior. Sadly though, there will be a few who won't pay attention and will continue trying to buy organic bedding and organic cotton products on the cheap. Please don't. Susan Fullen-Yurek is an ecommerce entrepreneur and owner of Kushtush Organics (http://www.kushtush.com). Susan believes in the great potential of organic markets, and the industry's deep commitments to humane and Fair Trade practices as logical approaches to solving global hunger. How to Waste Thousands of Dollars And Cause Yourself Years Of Misery
by champathon achille - Tuesday, 12 February 2008, 12:01 AM
Anyone in the world

By Franklin Pierce Read carefully. This could be your story. It was the night of my company's Christmas party. The
moon was full. Christmas music was playing on the car
radio. My wife and I were excited about a night out alone,
away from the kids. We quickly navigated the 10 miles from
our house to the hotel at which the party was being held. Upon arriving at the party, we made our way to the bar,
making full use of the 'free drink' coupons in the bag of
goodies that each employee received upon their arrival. My
wife ordered a glass of white wine. I had a gin and tonic.
After some mingling, we were seated and dinner was served.
We each drank a glass of Chardonnay with dinner. We also
had a cup of coffee with our dessert. After dinner and some presentations, a DJ opened up the
dance floor. We danced for the next two hours. During
this time, we each had about three additional glasses of
wine. As the night drew to a close, I drank a glass of
water to replenish some of the fluids I lost while dancing. We said our goodbyes and headed for our car. As we waited outside in the cold air for the valet to
bring up our car, I felt sober. I knew my limits, and this
certainly wasn't my limit. We laughed and sang to music as we drove home. We were
having a great time. I drove cautiously and carefully, as
I always do after I've been drinking. As we approached the exit to our house, I noticed a red
light and high beams on me in my rear view mirror. "Darn, I'm getting pulled over". My wife immediately
turned around and looked at the cop and started getting
nervous. She reached in her purse. "Here, have a mint'.
"Don't be moving around and acting suspicious", I snapped.
If I wasn't sober before, I felt completely sober now. The cop approached the car, and I rolled down my window.
"Your license and registration please". "Why did you pull me over officer?" I ask. "Your license
and registration please", he repeats sternly. I took out
my wallet, while my wife fumbled for the registration. I
handed both to the cop. He held up his flashlight and
reviewed the documents. He shined his flashlight into my eyes. "Have you had
anything to drink tonight?" I told him we'd just come from
my office Christmas party, but that I'd had only one drink.
I figured he might have smelled the alcohol on us, so he'd
know I was lying if I said 'nothing'. He walked back to his car and radioed in some information
about us. I thought about how I'd hoped to cap the night
off by driving my wife home and taking advantage of her as
soon as we walked in the door. Instead, my perfect night
was turning into a perfect nightmare. He walked back to our car, and before he could speak, I
asked if he would please just let us drive the mile down
the street to our house. The cop said that he would like
to administer a few tests, and that if I passed them, we
would be free to go. He asked that I get out of the car.
I was hopeful, as I stepped out of the car, that I would
pass his tests and we would be on our way. As I stood in front of the cop, I grew more and more
nervous as I considered that I might be arrested in front
of my wife, and that I would be spending the night in jail.
As the cop shined his flashlight directly into my eyes, I
was swiftly drawn back into the present. The cop held up a pen, and asked that I keep my head still
and follow the pen with only my eyes, as he moved it back
and forth in front of my face. I had no idea what he was
looking for, or how to tell if I'd passed this test. He then asked me to lean back, hold out my hands, close my
eyes and touch my nose with the tip of each finger. I
think I passed this test with flying colors. Next, he ordered me to place one hand flat on the other
and flip one hand over onto its back, starting slowly and
accelerating the pace. Again, I think I did great. Finally, he asked me to take a Breathalyzer test.
Hesitant, I asked him if I could please be allowed to go
home, since I passed all of his tests. "If you refuse to
take the test, you will be arrested and you will lose your
license for one year". I silently wondered if he was lying to me, as I looked him
in the eye and considered my options. I got a distinct
feeling that this cop didn't like me; almost as if I was his
enemy or perhaps a felon he wanted to arrest. Since I
wasn't sure of my rights and the law, I opted to take the
test. I was kicking myself for not taking the time in the
past to know my rights. Now that I needed that knowledge,
it was too late. As I blew into the Breathalyzer, I tried to blow out of my
nose to try and trick the machine, hoping that my breath
would mix with the outside air and provide a lower reading.
I also tried to pretend that I was blowing into the machine
with great effort, when I was really not blowing very hard
at all. The cop warned me to blow hard with my lips tight
around the unit. The machine came back with a reading of
'.08'. The legal limit is .08. "You are under arrest for driving under the influence of
alcohol. Turn around and place your hands on your head",
said the cop. It seemed surreal. One minute I was driving
home, laughing with my wife. The next minute I was being
arrested and hauled off to jail like a common criminal.
I'd never been arrested in my life. To make a long story short, my wife cried herself to sleep
that night. I hung out at the county jail all night,
getting harassed by various felony suspects. After I was
released I spent $8,000 on an attorney, missed several days
of work, got convicted of driving under the influence, and
paid a $1,500 fine. I performed dozens of hours of
community service, most of it feeling like an idiot while in
an orange vest picking up trash alongside the road. I lost
my license for 30 days. I had to complete a first time
offender's program and go to AA meetings. I also couldn't
drink alcohol for 90 days. My insurance premiums increased,
my relationship with my wife suffered due to the stress this
put us both under, and I was forced to ride my bike to work
for a month. I wish there was a happy ending, or at least a silver
lining. There wasn't. In fact, I'm still paying for that
mistake. I wish I'd known my rights and how to act in that
situation. Perhaps it would have turned out different. Learn from this man's mistakes. One DUI can make your
life a miserable existence that may drag on for months, or
even years. You can take your chances and continue to play
'DUI roulette' with your life, or you can be smart and
protect yourself by learning your rights and critical
strategies for avoiding a DUI arrest and conviction.
The choice is yours. Choose wisely. What can YOU do to avoid a DUI arrest and conviction?
